These terms cover the use of this website and the general conditions of our work. A specific garden is always governed by a signed contract; where the two differ, the contract wins.
1. This website
Photographs, illustrations, areas and years shown in the portfolio describe completed work. They are not a promise that your garden will look the same: soil, light, budget and time make every site different. Nothing on this site is a public offer.
2. First visit and proposal
The first site visit within Kyiv and a radius of forty kilometres is free. After it you receive a written proposal with the scope of design work, the stages, the timing and the fee. The proposal is valid for thirty days.
3. Design work
Design runs in stages — survey, concept, masterplan, working documentation — and each stage is accepted in writing before the next begins. Two rounds of revisions are included in each stage; further changes are charged by the hour at the rate stated in the contract.
4. Estimates and budget
Construction and planting estimates are prepared from approved drawings and are valid for thirty days, since plant and material prices follow the season and the exchange rate. Work found only after excavation begins — buried debris, old foundations, unmarked utilities — is agreed and priced separately before it is carried out.
5. Access and site conditions
You provide access to the site, water and electricity, and a place to store materials. Where a neighbour's permission, a management company's approval or a road closure is needed, we prepare the documents and you sign them. Weather delays — frozen ground, sustained rain, air-raid alerts — extend the schedule by the days lost.
6. Plants and guarantee
Plants are living material. We guarantee planting carried out by our crews for one full growing season, provided that the agreed watering and care regime is followed and that our maintenance programme or a documented equivalent is in place. The guarantee does not cover drought without irrigation, damage by animals, machinery or construction work by others, flooding, or a change in the level of groundwater.
7. Construction guarantee
Hardscape, drainage, irrigation and lighting installed by us are guaranteed for twenty-four months; roofing and waterproofing systems for the period stated by the manufacturer of the membrane, normally ten years, subject to annual inspection.
8. Payment
Design is paid in stages, on acceptance of each. Construction is paid against an agreed schedule, normally an advance for materials and then monthly against completed volumes. Plants and materials are ordered after the corresponding payment is received, because a nursery does not reserve stock without it.
9. Intellectual property
Drawings, planting plans and visualisations remain the intellectual property of Kaldervud. You receive an unlimited right to use them for building, operating and maintaining your own garden. Transferring them to another studio for a different site requires our written consent. The content of this website belongs to Kaldervud.
10. Changing your mind
You may stop the work at any stage. You pay for what has been done and for materials and plants already ordered; anything not yet ordered is cancelled at no cost. We hand over all drawings completed to that point.
11. Liability
Our liability is limited to the value of the corresponding stage of work. We are not liable for indirect losses. Nothing here limits liability that Ukrainian law does not allow to be limited.
12. Law and disputes
Ukrainian law applies. We settle disagreements by talking on site first; if that fails, by the competent court in Kyiv.
